Privacy Statement - Mobile Applications

This Privacy Statement applies to information collected through the use of a Mobile Application (“App”), provided by The Port Authority of New York and New Jersey and/or the Port Authority Trans-Hudson Corporation (PATH) (collectively “Port Authority”). We provide this statement in order to allow you to make an informed decision as to how to utilize this App. The following discloses our practices for collecting, using, maintaining, protecting, and disclosing information collected through the use of the App.


Information Collection and Use

The Port Authority will not sell, share, or rent the information you provide to us in any way other than those disclosed in this Privacy Statement. We collect information from and about users of the App when expressly provided by the user or automatically through use of the App as stated in this Privacy Statement. Unless you voluntarily provide it to us (for example, by creating an account or making a submission through the Feedback Section of this App) or opting in, we do not collect any personally identifiable information from your use or download of this App. “Personally Identifiable Information” is information which can be used to distinguish or trace an individual’s identity, which may include their name, social security number, driver’s license, fingerprints, biometric records, etc. which alone, or when combined with other personal or identifying information may be used to link or is linkable to a specific individual (such as date and place of birth, mother’s maiden name, etc.).

Location-based Information

We may collect the physical location of your device by, for example, using beacons and Bluetooth when you are in or near a PATH station or GPS and/or Wi-Fi to provide you with information relevant to a particular facility. We collect this location based information to provide you with transit arrivals, notifications and/or other information associated with a particular facility. We do not connect any location-based information about your device to any other personally identifiable information, and we do not retain any location-based data beyond the time in which we provide the facility information you requested or sought through use of the App. You can opt-out of sharing location-based information by disabling Bluetooth or location sharing in your mobile device’s settings. Please note that by disabling Bluetooth or location sharing certain features in the App may not be available or its functions may be limited.

Children under the age of 13

The App is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us through the Feedback Section in the App.

We collect and use your information for the following purposes:

  • To provide general information about the Port Authority, its facilities and your transportation options utilizing Port Authority facilities; and
  • To receive, process and respond to questions and/or comments that you send to us via the Feedback Section of the App.

Who We Share Your Personal Information With

We do not share your personal information with anyone except as required by law, Port Authority policy, or as necessary to conduct the business of the Port Authority to improve our services. Your personal information may be shared with the following:

  • Employees, contractors and agents of the Port Authority, pursuant to Port Authority policies and procedures;
  • Individuals who request information from the Port Authority, including, but not limited to, individuals who request information pursuant to the Port Authority Public Records Access Policy; and
  • Other governmental agencies for public safety, law enforcement or regulatory and/or investigatory purposes.

Requests for Access to Your Personal Information

If you would like to make a request for records containing your personal information, such request shall be made as set forth in the Port Authority Access to Personal Information Policy.

Security of Your Personal Information

The following describes some of the steps we have taken to protect your personal information:

  • Firewall protection of our databases;
  • Restriction of access to our databases, limited to authorized employees and contractors with authenticated passwords and dual factor authentication;
  • Frequent updates of virus protection software and security scans of our systems;
  • Data exchange protection through use of the secure file transfer and secure transmission; and
  • Data storage protection through use of encryption.

Third-Party Websites or Mobile Application

This App may direct you to other Mobile Applications or Web sites (collectively “Third Party Sites”) on your device that may be helpful or useful to you. The fact that such links are offered does not indicate the Port Authority’s adoption or endorsement of the content of any Third Party Sites. Once you have exited this App, you will be governed by the terms of use and privacy protections of the Third Party Sites to which you have been linked. Therefore, it is your sole responsibility to evaluate Third Party Sites to determine whether they are suited to your needs, including, among other things, whether the content is reliable, whether your privacy will be protected and whether the level of security provided is adequate for your particular use. Your use of Port Authority Web sites is governed by the Privacy Statement listed on such sites.

Changes to this Privacy Statement

We may revise this Privacy Statement from time to time. The Effective Date of the Privacy Statement will be listed at the top. You may view the Privacy Statement at any time in the Apple App Store and Google Play Store. Your continued access or use of the App after the Effective Date of the Privacy Statement, shall represent your acceptance of the Privacy Statement.
