The term &quot;TAPP Services&quot; includes the following: (i) the TAPPandRide.com website (the &quot;\u003Cb\u003EWebsite\u003C/b\u003E&quot;); (ii) the TAPP fare payment services, including TAPP fare payment readers, TAPP vending machines, and other related technology (the &quot;\u003Cb\u003ETAPP Fare Payment System\u003C/b\u003E&quot;); and (iii) the PATH customer support services (&quot;\u003Cb\u003EPATH TAPP Customer Service\u003C/b\u003E&quot;).\u003C/p\u003E\r\n\u003Cp\u003EBy using the TAPP Services, you accept and agree to be bound by these TAPP Terms of Service and other applicable PATH policies, including the TAPP Privacy Policy, Port Authority’s Freedom of Information Policy, PATH’s fare policies, and other applicable laws (collectively, the “\u003Cb\u003EApplicable Terms\u003C/b\u003E”).\u003C/p\u003E\r\n\u003Cp\u003EPLEASE READ THESE TAPP TERMS OF SERVICE CAREFULLY BEFORE YOU ACCESS OR USE THE TAPP SERVICES. YOUR USE OR ACCESS OF THE TAPP SERVICES CONSTITUTES ACCEPTANCE OF ALL TERMS AND CONDITIONS CONTAINED HEREIN, AS WELL AS THE APPLICABLE TERMS, AND YOU AGREE TO BE BOUND BY THESE TAPP TERMS OF SERVICE AND APPLICABLE TERMS. IF YOU DO NOT WISH TO BE LEGALLY BOUND BY THESE TAPP TERMS OF SERVICE AND APPLICABLE TERMS, THEN PLEASE DO NOT ACCESS OR USE THE TAPP SERVICES.\u003C/p\u003E\r\n\u003Cp\u003E1.&nbsp;\u003Cb\u003E\u003Cu\u003EYour Agreement to these TAPP Terms of Service\u003C/u\u003E\u003C/b\u003E. &nbsp;These TAPP Terms of Service set forth the terms and conditions under which you agree to use the TAPP Services. For the avoidance of doubt, these TAPP Terms of Service apply to anyone that accesses or uses the TAPP Services (collectively, &quot;\u003Cb\u003Eyou\u003C/b\u003E&quot;, &quot;\u003Cb\u003Eyour\u003C/b\u003E&quot;, “\u003Cb\u003Ecustomer(s)\u003C/b\u003E”, and “\u003Cb\u003Euser(s)\u003C/b\u003E”), including those who create a TAPP customer account (each, a &quot;\u003Cb\u003ETAPP Customer Account\u003C/b\u003E&quot;), visitors to the Website, and users of the TAPP Fare Payment System.\u003C/p\u003E\r\n\u003Cp\u003Ea. By accessing or otherwise using the TAPP Services, you acknowledge that you have read these TAPP Terms of Service and Applicable Terms and agree to be legally bound by them. PATH may also confirm your agreement to be bound by these TAPP Terms of Service by asking you to click an &quot;I accept&quot; or similar button when you use certain portions of PATH's TAPP Services. For example, by accessing the TAPP Services (i) on any computer, mobile phone, tablet, console, or other device, (ii) via a social media platform or search engine, or (iii) through use of a TAPP Payment Method, as defined herein, you confirm that you have read, understood, and agreed to be legally bound by these TAPP Terms of Service, whether or not you have registered for a TAPP Customer Account.\u003C/p\u003E\r\n\u003Cp\u003Eb. If you are agreeing to these TAPP Terms of Service on behalf of a company or other legal entity (“\u003Cb\u003EYour Entity\u003C/b\u003E”), you are agreeing that (i) you represent and warrant that you are authorized to act on behalf of, and bind, Your Entity, (ii) for the purposes of these TAPP Terms of Service, the term “you” means Your Entity on whose behalf you are acting, and (iii) you agree to be bound by any and all Applicable Terms.\u003C/p\u003E\r\n\u003Cp\u003E2.&nbsp;\u003Cb\u003E\u003Cu\u003EOverview of the TAPP Fare Payment System\u003C/u\u003E\u003C/b\u003E.\u003C/p\u003E\r\n\u003Cp\u003Ea.&nbsp;&nbsp;\u003Cu\u003EPATH Transit Fares\u003C/u\u003E. &nbsp;Current fares collected using the TAPP Fare Payment System are set out in PATH's fare policies and applicable law. Such fares are subject to change in accordance with PATH's fare policies and applicable law. Fares default to the non-discounted fare (“\u003Cb\u003EFull Fare\u003C/b\u003E”) unless and until a Reduced Fare Program application is approved pursuant to Section 7 entitled “Reduced Fare Program”. For information regarding current fares and fare policies related to the TAPP Services, visit: \u003Ca href=\"https://www.panynj.gov/path/en/fares.html\"\u003Ehttps://www.panynj.gov/path/en/fares.html\u003C/a\u003E.\u003C/p\u003E\r\n\u003Cp\u003Eb.&nbsp;\u003Cu\u003ETAPP Payment Methods\u003C/u\u003E. &nbsp;You may pay your PATH transit fare via the TAPP Fare Payment System by using any of the compatible “\u003Cb\u003ETAPP Payment Methods\u003C/b\u003E” as listed below:\u003C/p\u003E\r\n\u003Cp\u003Ei. contactless credit, debit, or prepaid card or digital wallet on a smart device, such as a smart phone or a wearable device (for example, Apple Pay, Google Pay, Samsung Pay, and Fitbit Pay) (collectively, “\u003Cb\u003EPAYGO Media\u003C/b\u003E”); and/or\u003C/p\u003E\r\n\u003Cp\u003Eii. PATH-issued TAPP contactless fare payment card (a &quot;\u003Cb\u003ETAPP Card\u003C/b\u003E&quot;).\u003C/p\u003E\r\n\u003Cp\u003EPATH may enable additional TAPP Payment Methods in the future.\u003C/p\u003E\r\n\u003Cp\u003Ec.&nbsp;\u003Cu\u003EHow to Use TAPP\u003C/u\u003E. &nbsp;You may use a TAPP Payment Method with the TAPP Fare Payment System by &quot;tapping&quot; or holding your TAPP Payment Method up to a TAPP Fare Payment System reader. Except for permitted transfers, you will be charged the applicable fare each time you tap. To ensure proper functioning, you should remove your contactless TAPP Payment Method from your wallet or other card holder before you tap. You should only tap using the TAPP Payment Method you wish to use to pay a fare via a TAPP Fare Payment System reader. PATH is not responsible if your fare is charged to a payment method or through a mobile device that you did not intend to use due to your failure to properly adhere to the instructions set out in these TAPP Terms of Service or other instructions available via the TAPP Services. If, however, two forms of payment are inadvertently read by the TAPP Fare Payment System reader during one tap of a TAPP Payment Method, and you are charged twice for the same transit fare, you may request a refund for the inadvertently charged fare by contacting PATH TAPP Customer Service as described in Section 14 entitled “Overpayments and Refunds”.\u003C/p\u003E\r\n\u003Cp\u003Ed.&nbsp;\u003Cu\u003EOnly One TAPP Payment Method Allowed at a Time\u003C/u\u003E. &nbsp;You may only use one TAPP Payment Method to pay a fare via a TAPP Fare Payment System reader – you cannot split a fare among different TAPP Payment Methods or between a TAPP Payment Method and a SmartLink\u003Csup\u003E® \u003C/sup\u003ECard, MetroCard, 2-Trip PATH Only MetroCard, or SingleRide Ticket (collectively, “\u003Cb\u003ELegacy PATH Payment Methods\u003C/b\u003E”). If a TAPP Payment Method is declined, you may try another TAPP Payment Method or, in the alternative, use a Legacy PATH Payment Method at a legacy turnstile. PATH retains the right to discontinue any Legacy PATH Payment Method.\u003C/p\u003E\r\n\u003Cp\u003Ee.&nbsp;\u003Cu\u003ETransit Account\u003C/u\u003E. &nbsp;Each TAPP Payment Method is associated with an account (a “\u003Cb\u003ETransit Account\u003C/b\u003E”). A Transit Account associated with a TAPP Card or PAYGO Media may be linked to a TAPP Customer Account. For TAPP Cards, your Transit Account will contain any stored value or products that you have loaded to your TAPP Card. Each Transit Account will be assigned a rider classification, which is used to determine the fare to charge, the selection of fare products available for purchase, and any travel/transfer privileges allowed. Transit Accounts default to the Full Fare unless and until a Reduced Fare Program application is approved pursuant to Section 7 entitled “Reduced Fare Program”.\u003C/p\u003E\r\n\u003Cp\u003E3.&nbsp;\u003Cb\u003E\u003Cu\u003EYour TAPP Customer Account\u003C/u\u003E.\u003Cu\u003E\u003C/u\u003E\u003C/b\u003E\u003C/p\u003E\r\n\u003Cp\u003Ea.&nbsp;\u003Cu\u003ECreation of a TAPP Customer Account\u003C/u\u003E.&nbsp; The TAPP Services include the ability to create and use a TAPP Customer Account. You can create a TAPP Customer Account via the TAPP Website or by calling PATH TAPP Customer Service. If you create a TAPP Customer Account by calling PATH TAPP Customer Service, you will be required to verify the email provided during account creation. You must be 18 years of age or older in order to create a TAPP Customer Account, and by creating a TAPP Customer Account, you represent and warrant to PATH that you are at least 18 years old at the time of registration. As further set out in the TAPP Privacy Policy, you must provide PATH with certain information, including Personal Information, in order to create a TAPP Customer Account. For youth under 18 years of age, a parent or guardian may order and link a TAPP Payment Method to their TAPP Customer Account. You are not required to create a TAPP Customer Account in order to use the TAPP Fare Payment System, though certain TAPP Services are only available to those with a TAPP Customer Account. There are certain beneﬁts to creating a TAPP Customer Account, including balance protection.\u003C/p\u003E\r\n\u003Cp\u003Eb.&nbsp;\u003Cu\u003ETAPP Customer Account Password\u003C/u\u003E. &nbsp;TAPP Customer Accounts are only available to users who have completed the account registration process and created a TAPP Customer Account password. If you created a TAPP Customer Account, then please understand that PATH will treat anyone who uses your password as &quot;you&quot;. PATH will provide this user with all of the rights and privileges that PATH provides to you, and PATH will hold you responsible for user activities associated with your TAPP Customer Account and password. PATH therefore recommends that you maintain your TAPP Customer Account and password in confidence, and that you do not share your TAPP Customer Account and password with anyone who might pretend to be you with respect to your use of the TAPP Services (including your TAPP Customer Account). Please notify PATH TAPP Customer Service immediately if you suspect that someone is using your TAPP Customer Account and password in an inappropriate manner.\u003C/p\u003E\r\n\u003Cp\u003Ec.&nbsp;\u003Cu\u003ELinking of Transit Accounts to a TAPP Customer Account\u003C/u\u003E. &nbsp;You can link up to ten (10) Transit Accounts to a TAPP Customer Account. You can link one (1) TAPP Payment Method to a TAPP Transit Account. A Transit Account can only be linked to one (1) TAPP Customer Account. You can register and link a Transit Account to your TAPP Customer Account via the Website or by contacting PATH TAPP Customer Service. In linking Transit Accounts, you agree to ensure that all information provided is true, accurate, and complete.\u003C/p\u003E\r\n\u003Cp\u003Ed.&nbsp;\u003Cu\u003EBenefits of Registration\u003C/u\u003E.\u003C/p\u003E\r\n\u003Cp\u003Ei.&nbsp;\u003Cu\u003EBalance Protection\u003C/u\u003E. &nbsp;Only a registered TAPP Card is eligible for balance protection in the event that the TAPP Card is lost, stolen, or damaged. You may apply to PATH for the cancellation of a lost, stolen, or damaged TAPP Card and the issuance of a new TAPP Card, subject to the payment of any fees. You are responsible for any payments made with the TAPP Card up until PATH receives your notice that your TAPP Card is lost, stolen, or damaged and PATH blocks your TAPP Card. See Section 15 entitled “Lost, Stolen, or Damaged Card or Device Linked to a TAPP Customer Account” for additional details.\u003C/p\u003E\r\n\u003Cp\u003Eii.&nbsp;\u003Cu\u003EAlternate User(s)\u003C/u\u003E. &nbsp;If you have a registered TAPP Customer Account, you may add up to five (5) alternate users on your TAPP Customer Account. The alternate users will be able to perform functions on your behalf, including but not limited to purchasing products, adding or removing media, or adding or removing funding sources. You will need to contact PATH TAPP Customer Service to add alternate users to your Customer Account. The alternate user(s) must also be registered in order to be added to the account. PATH will provide the alternate user(s) with all of the rights and privileges that PATH provides to you, and PATH will hold you responsible for user activities associated with your TAPP Customer Account.\u003C/p\u003E\r\n\u003Cp\u003Eiii.&nbsp;\u003Cu\u003EAdditional Benefits of Registered Transit Accounts\u003C/u\u003E. &nbsp;Registered Transit Accounts also provide the ability to (i) set up and change Transit Account funding sources; (ii) enable and configure automatic reload (“\u003Cb\u003Eauto-reload\u003C/b\u003E”); (iii) receive account and information alerts by email; (iv) view, print, and query transaction history and statements; and (v) pay any outstanding debt to PATH.\u003C/p\u003E\r\n\u003Cp\u003Ee.&nbsp;\u003Cu\u003EUnregistered TAPP Payment Methods\u003C/u\u003E. &nbsp;For unregistered TAPP Payment Methods, including unregistered TAPP Cards and PAYGO Media, no personal information is stored. You are not required to register your TAPP Payment Method in order to use the TAPP Fare Payment System. If a TAPP Card is not registered to a TAPP Customer Account, you forfeit balance protection and the other benefits of registered Transit Accounts.\u003C/p\u003E\r\n\u003Cp\u003Ef.&nbsp;\u003Cu\u003ERemoving a TAPP Payment Method or Transit Account from TAPP Customer Account\u003C/u\u003E. &nbsp;You can remove a TAPP Payment Method or Transit Account from your TAPP Customer Account via the Website or by contacting PATH TAPP Customer Service. Transit Accounts cannot be deregistered if there is a negative balance on the Transit Account. Additionally, some Transit Accounts, such as Reduced Fare Transit Accounts, require your personal information and thus cannot be deregistered. If you deregister a Transit Account, you will forfeit balance protection and other benefits of registered Transit Accounts. While you will no longer be able to access transaction history, PATH will retain customer data and transaction history associated with deregistered accounts in accordance with the TAPP Privacy Policy. PATH reserves the right to impose fees for deregistering TAPP Payment Methods and Transit Accounts.\u003C/p\u003E\r\n\u003Cp\u003Eg.&nbsp;\u003Cu\u003EDeregistration of TAPP Customer Account\u003C/u\u003E. &nbsp;Customers can deregister a TAPP Customer Account via the Website or by contacting PATH TAPP Customer Service. Deregistration of a TAPP Customer Account via the Website will require the customer to delink each individual Transit Account and remove any active auto-reloads in the TAPP Customer Account. You will forfeit balance protection and other benefits of the deregistered TAPP Customer Accounts. While you will no longer be able to access transaction history, PATH will retain customer data and transaction history associated with a deregistered accounts in accordance with the TAPP Privacy Policy. PATH reserves the right to impose fees for deregistering TAPP Customer Accounts.\u003Cb\u003E\u003Cu\u003E\u003C/u\u003E\u003C/b\u003E\u003C/p\u003E\r\n\u003Cp\u003E4.&nbsp;\u003Cb\u003E\u003Cu\u003ETAPP Products\u003C/u\u003E.\u003Cu\u003E\u003C/u\u003E\u003C/b\u003E\u003C/p\u003E\r\n\u003Cp\u003Ea.&nbsp;\u003Cu\u003ETAPP Cards\u003C/u\u003E.&nbsp; Customers can obtain a TAPP Card via the Website, at a TAPP vending machine, or by calling PATH TAPP Customer Service. If ordering a TAPP Card by calling PATH TAPP Customer Service, you must have a registered Customer Account with a saved funding source. If ordering a TAPP Card via the Website, you will be required to provide limited contact information. Fare media fees as well as shipping fees may apply. Only PATH, a TAPP Program Administrator (e.g., your employer or another institution), or an authorized distributor may provide you with an authorized TAPP Card.\u003C/p\u003E\r\n\u003Cp\u003Eb.&nbsp;\u003Cu\u003ETAPP Fare Products\u003C/u\u003E.&nbsp; TAPP fare products can be loaded into a Transit Account and represent prepaid fares on PATH. The three types of fare products include:\u003C/p\u003E\r\n\u003Cp\u003Ei. Stored Value – unrestricted, post-tax prepaid value that may be used to pay a fare or purchase a multi-trip product.\u003C/p\u003E\r\n\u003Cp\u003Eii. “\u003Cb\u003ETransit Commuter Benefits\u003C/b\u003E” Stored Value – subsidized or pre-tax funds as allowed by Internal Revenue (IRS) Code Section 132 that may be used to pay a fare or purchase a multi-trip product.\u003C/p\u003E\r\n\u003Cp\u003Eiii. Multi-Trip Product – prepaid trips that may be used to pay a fare.\u003C/p\u003E\r\n\u003Cp\u003EFor information regarding current fares and fare policies related to the TAPP Services, visit: \u003Ca href=\"https://www.panynj.gov/path/en/fares.html\"\u003Ehttps://www.panynj.gov/path/en/fares.html\u003C/a\u003E.\u003C/p\u003E\r\n\u003Cp\u003Ec.&nbsp;\u003Cu\u003ETAPP Product Purchases\u003C/u\u003E. &nbsp;You can purchase TAPP products and stored value at a TAPP vending machine, via the Website, or by calling PATH TAPP Customer Service, if you have a funding source already set up for your Customer Account. Your ability to purchase and load a multi-trip product into a Transit Account may be limited based on existing products in the Transit Account or rider classification of the Transit Account. You may also travel by paying with PAYGO Media. The products available may vary based on the sales channel. PATH reserves the right to make changes to its sales channels.\u003C/p\u003E\r\n\u003Cp\u003Ed.&nbsp;\u003Cu\u003EPriority of Fare Payment Transactions\u003C/u\u003E. &nbsp;When a Transit Account holds an active multi-trip product, no deduction from the Transit Account’s stored value or activation of a product will be made unless required for fare payment for multiple riders. For Transit Accounts with multiple products, the products shall be prioritized with fares deducted from the applicable product. Details on the priority rules for which pass will be used are available on the Website.\u003C/p\u003E\r\n\u003Cp\u003Ee.&nbsp;\u003Cu\u003EPAYGO Fare\u003C/u\u003E. &nbsp;If you use PAYGO Media, you will be charged a Pay-As-You-Go Full Fare (“\u003Cb\u003EPAYGO Full Fare\u003C/b\u003E”). However, if you are registered as part of a Reduced Fare Program, defined in Section 7 herein, you may link PAYGO Media to your Reduced Fare Transit Account to be charged the Reduced Fare. The first time that you use a new PAYGO Media, PATH may attempt to authorize payment for a nominal amount immediately. If the authorization is declined, the PAYGO Media will be blocked, and subsequent usage will be declined. A chargeback issued against a PAYGO account will result in the automatic blocking of the PAYGO Media. The PAYGO Media will not be able to be used until it is manually unblocked by PATH. PATH may aggregate transactions rather than charging you for each individual ride or may charge a temporary hold that will eventually be superseded by the aggregated total. While PAYGO transactions may be aggregated together on your card statement, for registered PAYGO Media, individual transactions can be viewed in your TAPP Customer Account.\u003C/p\u003E\r\n\u003Cp\u003Ef.&nbsp;\u003Cu\u003EPayment for Multiple Riders\u003C/u\u003E. &nbsp;You may use your TAPP Payment Method to pay for you and additional persons riding with you on PATH within five (5) minutes of your first tap. Your Transit Commuter Benefit stored value cannot be used to pay fares for additional riders. After five (5) minutes from your first tap, you cannot use your TAPP Payment Method at the same station for eighteen (18) minutes. PATH reserves the right to modify its policy for payment for multiple riders. Additional details are available on the Website.\u003C/p\u003E\r\n\u003Cp\u003Eg.&nbsp;\u003Cu\u003ETAPP Card Inactivity and Dormancy Fee\u003C/u\u003E. &nbsp;An inactive Transit Account is defined as a Transit Account with no use or sale transactions in 730 days. For inactive Transit Accounts associated with a TAPP Card, following 730 days of inactivity, a dormancy fee of $5 per month of stored value, excluding Transit Commuter Benefits stored value, may be deducted from any remaining stored value until the balance is reduced to zero. If the stored value in the Transit Account is less than the dormancy fee, the remaining value in your Transit Account will be reduced to zero. You can stop the monthly deduction of the dormancy fee at any time with a single use of the TAPP Card for transit or by adding value to your TAPP Card. If you have registered your Transit Account to a TAPP Customer Account and provided contact information, you will be sent a warning notice to the email in the TAPP Customer Account prior to the initial assessment of the dormancy fee to inform you that a dormancy fee will soon be charged if your Transit Account remains inactive.\u003C/p\u003E\r\n\u003Cp\u003Eh.&nbsp;\u003Cu\u003EExpiration of Products\u003C/u\u003E. &nbsp;The expiration dates of products vary by product. Unused trips on multi-trip products will expire after a set time period after purchase. PATH reserves the right to modify the expiration of products. Details on specific expiration dates by product are available at \u003Ca href=\"https://www.panynj.gov/path/en/fares.html\"\u003Ehttps://www.panynj.gov/path/en/fares.html\u003C/a\u003E.\u003C/p\u003E\r\n\u003Cp\u003E5.&nbsp;\u003Cb\u003E\u003Cu\u003ETAPP Card Funding Requirements\u003C/u\u003E\u003C/b\u003E.\u003C/p\u003E\r\n\u003Cp\u003Ea.&nbsp;\u003Cu\u003EFunding Sources\u003C/u\u003E. &nbsp;If you have a registered TAPP Customer Account, you can set up funding sources that can be used to fund purchases made on Transit Accounts. Multiple denials of a funding source may result in a disallowance of your ability to use that funding source.\u003C/p\u003E\r\n\u003Cp\u003Eb.&nbsp;\u003Cu\u003EMinimum Balance\u003C/u\u003E. &nbsp;You must have a minimum balance in your Transit Account in order to use your TAPP Card for travel. Unless you have a multi-trip product in your Transit Account, the minimum balance is the cost of a single trip as established in the current fares and fare policies related to the TAPP Services found here: \u003Ca href=\"https://www.panynj.gov/path/en/fares.html\"\u003Ehttps://www.panynj.gov/path/en/fares.html\u003C/a\u003E. The TAPP Card will be declined if the combined stored value balance in the Transit Account stored is negative or below the minimum balance required to travel. The combined stored value balance includes stored value and Transit Commuter Benefits stored value, as defined in “TAPP Fare Products” herein. To use the TAPP Card, you will need to load stored value until the Transit Account stored value balance is at least the minimum balance required to travel, or the balance is at least $0.00 and another valid product is available for use in your Transit Account.\u003C/p\u003E\r\n\u003Cp\u003Ec.&nbsp;\u003Cu\u003EMinimum Load\u003C/u\u003E. &nbsp;PATH may require a minimum add value amount when you acquire or reload a TAPP Card. Partial stored value reloads that do not bring the combined Transit Account stored value balance to $0.00 or above may not be allowed.\u003C/p\u003E\r\n\u003Cp\u003Ed.&nbsp;\u003Cu\u003EMaximum Stored Value\u003C/u\u003E. &nbsp;The maximum allowed Transit Account balance is $500.00, including Transit Commuter Benefits stored value. If you try to load value that causes the balance to exceed $500.00, the transaction or order will be declined and will not be processed. You are responsible for knowing your balance.\u003C/p\u003E\r\n\u003Cp\u003Ee.&nbsp;\u003Cu\u003ELimit on the Number of Products in a Transit Account\u003C/u\u003E. &nbsp;PATH may limit the total number of multi-trip products that you can load into a Transit Account and in a transaction.\u003C/p\u003E\r\n\u003Cp\u003Ef.&nbsp;&nbsp;\u003Cu\u003ETransit Commuter Benefits\u003C/u\u003E. &nbsp;The TAPP Services allows you to purchase transit fare products with subsidized or pre-tax funds as allowed by IRS Code Section 132. These funds are added to your Transit Account as Transit Commuter Benefits stored value in order to ensure the funds are kept separate from other stored value funds you may load into your Transit Account. When Transit Commuter Benefits stored value is loaded into your Transit Account, you can use that value to purchase multi-trip products or use as stored value to pay an individual fare. Your participation in your employer's “\u003Cb\u003ETransit Commuter Benefits Program\u003C/b\u003E” and your use of Transit Commuter Benefits Program dollars is subject to certain laws, rules, and regulations including IRS Code Section 132(f). PATH disclaims any and all liability for the failure of you or your employer to follow any and all laws, rules or regulations that govern your Transit Commuter Benefits Program dollars and/or your employer's Transit Commuter Benefits Program. Your pre-tax payroll funds may only be used to pay for rides you take to and from work and work-related purposes. As such, sharing your TAPP Payment Method associated with your Transit Commuter Benefits is strictly prohibited. PATH reserves the right to suspend your account for misuse of Transit Commuter Benefits Program funds or to take any other appropriate action. You may only discontinue participation in a Transit Commuter Benefits Program through your employer. If there is remaining value in your Transit Account, it will continue to be available to you for transit. PATH cannot issue refunds of Transit Commuter Benefits stored value under any circumstance. It is your responsibility to apply for a refund from your employer or your employer's third-party administrator in accordance with your employer's policy and applicable law.\u003C/p\u003E\r\n\u003Cp\u003Ei.&nbsp;\u003Cu\u003EWhen PATH may Block Access to your TAPP Services\u003C/u\u003E. &nbsp;PATH may temporarily or permanently block your access to the TAPP Services, in certain circumstances, including:\u003C/p\u003E\r\n\u003Cp\u003E&nbsp;i.&nbsp;\u003Cu\u003ETemporary Block\u003C/u\u003E. &nbsp;PATH may temporarily block your use of a specific TAPP Payment Method to access the TAPP Services if: (i) such registered TAPP Card is reported to PATH as lost, stolen, or damaged; (ii) there are insufficient funds associated with the TAPP Payment Method, and additional funds have not yet been cleared; (iii) there is suspicion of fraudulent or other illegal activity in connection with the use of such TAPP Payment Method; (iv) TAPP Payment Method or the funding source associated with such TAPP Payment Method is declined by the ﬁnancial institution when PATH submits the charge to such financial institution or (v) for any reason at PATH’s sole discretion; and\u003C/p\u003E\r\n\u003Cp\u003Eii.&nbsp;\u003Cu\u003EPermanent Block\u003C/u\u003E. &nbsp;PATH may permanently block your use of a specific TAPP Payment Method to access the TAPP Services if: (i) there is verified fraudulent or other illegal activity in connection with the use of such TAPP Payment Method; (ii) such TAPP Payment Method is reported stolen to PATH; (iii) there is use of a Reduced Fare TAPP Payment Method by someone other than the person identified on the Reduced Fare Program application, or (iv) for any reason at PATH’s sole discretion.\u003C/p\u003E\r\n\u003Cp\u003Ej.&nbsp;\u003Cu\u003EHow to Remove a Temporary Block on Your TAPP Payment Method\u003C/u\u003E. &nbsp;After you have resolved any issues with your TAPP Payment Method, a temporary block may be removed, if possible, by contacting PATH TAPP Customer Service. In some instances, a temporary block may be removed in your TAPP Customer Account on the Website.\u003C/p\u003E\r\n\u003Cp\u003E6.&nbsp;\u003Cb\u003E\u003Cu\u003EAutomatic Reload\u003C/u\u003E.\u003Cu\u003E\u003C/u\u003E\u003C/b\u003E\u003C/p\u003E\r\n\u003Cp\u003Ea.&nbsp;\u003Cu\u003EAutomatic Reload of Transit Value\u003C/u\u003E.&nbsp; If you have a registered TAPP Customer Account and valid funding source(s) on file, you can set up your Transit Accounts for auto-reload. By setting up auto-reload, you authorize PATH to automatically reload stored value or a product to your Transit Account by means of a credit or debit card or through an Automated Clearing House (ACH) transfer whenever the Transit Account’s stored value balance falls below a pre-defined amount as specified on the Website. PATH may require a minimum add value amount for auto-reload as specified on the Website. The maximum amount of stored value that can be into a Transit Account via auto-reload is as defined in Section 5(d) entitled “Maximum Stored Value”. To set up auto-reload for a product, a product of that type must be already loaded into the Transit Account. For products, the amount charged to the funding source will be based on the price in effect at the time of auto-reload. You can enable, cancel, or modify your auto-reload via the Website or by contacting PATH TAPP Customer Service if you have a registered TAPP Customer Account and valid funding source(s) on file.\u003C/p\u003E\r\n\u003Cp\u003Eb.&nbsp;\u003Cu\u003EAutomatic Reload Funding Sources\u003C/u\u003E. &nbsp;Auto-reloads will only use your selected funding source(s) to make the purchase. You may use up to two funding sources in the Transit Account: a primary funding source and a secondary funding source. Transit Commuter Benefits stored value may be combined with either a credit or debit card or an ACH transfer to provide full funding for the auto\u003Cu\u003E-\u003C/u\u003Ereload. The sources of funds will be selected by you during auto-reload setup. Your primary funding source will be debited the specified amount with the secondary funding source charged with the remaining amount. The stored value or product will be loaded into the Transit Account after the payment transaction is authorized or the payment request (i.e., ACH) is credited successfully.\u003C/p\u003E\r\n\u003Cp\u003Ec. Eligibility for users with a qualifying disability is valid for the duration of the disability, as evidenced by documentation provided, but must be renewed every four years or if temporary qualifying disability continues. You may find the expiration date of your Reduced Fare eligibility by logging into your TAPP Customer Account or contacting PATH TAPP Customer Service. PATH will notify you prior to expiration using the email on file. The primary method of contact will be email, but PATH may contact you by other methods. It is the responsibility of the Reduced Fare Rider to recertify prior to the expiration of their Reduced Fare eligibility. Additionally, any status change that would result in a loss of eligibility must be reported immediately to PATH. For riders with qualifying disabilities, the Reduced Fare Program benefit is valid only if you are disabled as stated on your application. If at any time you are no longer disabled as described, your eligibility for the Reduced Fare Program automatically ceases and you will no longer be permitted to use the Reduced Fare benefit. As between you and PATH, all information, software, artwork, text, video, audio, pictures, logos, and other content available on or through the TAPP Services (except for User Content, as defined in Section 12 entitled “User Content”), including all associated Intellectual Property Rights (collectively, the “\u003Cb\u003ETAPP Services Content\u003C/b\u003E”), is the property of PATH or its licensors, is protected by copyright and other intellectual property laws, or is included based on principles of “fair use”. PATH and its licensors retain all rights with respect to TAPP Services Content except those expressly granted to you in Section 11 entitled “Limited Grant of Rights to You”. Third-party trademarks that appear in connection with the TAPP Services are the property of their respective owners. Although PATH may review User Content prior to using it, PATH makes no representations or warranties regarding any User Content or PATH's review of such User Content. In general, PATH does not issue refunds. However, in rare circumstances, PATH reserves the right to apply a Transit Account credit. If you request a refund or adjustment, you may be required to provide your contact information. All other refund requests are governed by the fare policies described in Section 2(a) entitled “PATH Transit Fares”.\u003C/p\u003E\r\n\u003Cp\u003E15.&nbsp;\u003Cb\u003E\u003Cu\u003ELost, Stolen, or Damaged Card or Device Linked to a TAPP Customer Account\u003C/u\u003E.\u003Cu\u003E\u003C/u\u003E\u003C/b\u003E\u003C/p\u003E\r\n\u003Cp\u003Ea.&nbsp;\u003Cu\u003ELost, Stolen, or Damaged TAPP Payment Method\u003C/u\u003E. &nbsp;It is important that you report immediately any lost, stolen, or damaged TAPP Payment Method(s) to PATH and, if applicable, the card issuer. You can a report a lost, stolen, or damaged TAPP Payment Method to PATH via the Website or by calling PATH TAPP Customer Service. Once you notify PATH that your TAPP Payment Method is lost, stolen, or damaged, PATH will block this TAPP Payment Method from use with the TAPP Fare Payment System. Your TAPP Payment Method may continue to be charged for taps made at TAPP Fare Payment System readers until PATH receives your notice that your card is lost, stolen, or damaged and PATH blocks your card. For registered TAPP Cards, the balance in your Transit Account is protected only after you report the loss or damage to PATH and PATH receives your notice. If you later find the TAPP Payment Method that has not been permanently blocked, you may unblock the TAPP Payment Method by contacting PATH TAPP Customer Service and continue to use it. In some instances, a temporary block may be removed in your TAPP Customer Account on the Website. However, the expiration date of any active or inactive product would not have been paused. You are responsible for notifying your credit or debit bank card provider regarding lost or stolen cards, and your mobile provider regarding lost or stolen mobile devices.\u003C/p\u003E\r\n\u003Cp\u003Eb.&nbsp;\u003Cu\u003EDefective TAPP Cards\u003C/u\u003E. &nbsp;You shall not alter or interfere with the graphic or data of a TAPP Card and shall take care to ensure that it is not interfered or tampered with. TAPP Cards that have been visibly altered will be considered damaged and not defective. A TAPP Card that has not been damaged and becomes inoperable within ninety (90) days after issuance will be replaced by PATH at no charge to you upon presentation to PATH. In addition, the trips remaining on the malfunctioning TAPP Card may be transferred to the replacement TAPP Card, if the malfunctioning TAPP Card, as applicable, can be identified by the serial number imprinted on the card or by TAPP Customer Account or Transit Account. In some instances, PATH may elect to replace unused trips on a malfunctioning TAPP Card by other fare media. Determination that a malfunction is due to a manufacturer's defect shall be made solely by PATH, and such determination is final and uncontestable. PATH may ask you to verify your identity. You must present the defective TAPP Card to PATH. The defective TAPP Card will not be returned to you and will be made inoperable. If you cancel your TAPP Payment Method or if your TAPP Customer Account or Transit Account\u003Cb\u003E \u003C/b\u003Eis terminated pursuant to these terms, you will remain responsible for any and all fares that are due or become due on your Transit Account.
